Terms and conditions
These terms and conditions ("Terms", "Agreement") are an agreement between Plexus Manufacturing Sdn Bhd ("Plexus", "us", "we" or "our") and you ("User", "you" or "your"). This Agreement sets forth the general terms and conditions of your use of the mobile application known as “myPlexus” and any of its content/services (collectively, "myPlexus" or "Services"). By accessing or using myPlexus, you agree to be bound by the Terms of this Agreement and you acknowledge that you have read and agreed to all the Terms.
Accounts and membership
You must be an employee of Plexus to use myPlexus. You are responsible for maintaining the security of your account and you are fully responsible for all activities that occur under the account and any other actions taken in connection with it. You must immediately notify us of any unauthorized use of your account or any other breaches of security. We will not be liable for any acts or omissions by you, including any damages of any kind incurred as a result of such acts or omissions. We may suspend, disable, or delete your account (or any part thereof) if we determine that you have violated any provision of this Agreement or that your conduct or submitted content may damage our reputation and/or goodwill.
Links to other third party sites
myPlexus contains links to third party sites and other sources provided by third parties (“Third Party Sites”). In this respect, Plexus shall not, whether directly or indirectly, be deemed as having provided any approval, association, sponsorship, endorsement, or affiliation with such Third Party Sites, unless specifically stated. We shall not be responsible for examining or evaluating, and we do not warrant, the offerings of any businesses or individuals or the content of such Third Party Sites. We do not assume any responsibility or liability for the actions, products, services, and content provided by third parties. You should carefully review the terms and conditions of use of any Third Party Sites which you access through a link from myPlexus. Your access to and use of such Third Party Sites is at your own risk.
Intellectual property rights
This Agreement does not transfer to you any intellectual property owned by Plexus or third parties, and all rights, titles, and interests in and to such property will remain (as between the parties) solely with Plexus. All trademarks, service marks, graphics and logos used in connection with myPlexus or the Services, are trademarks or registered trademarks of Plexus or Plexus licensors. Other trademarks, service marks, graphics and logos used in connection with myPlexus or the Services may be the trademarks of other third-parties. Your use of myPlexus and the Services does not grant you any right or license to reproduce or otherwise use any Plexus or third-party trademarks.
Limitation of liability
To the fullest extent permitted by applicable law, in no event will Plexus, its affiliates, officers, directors, employees, agents, suppliers or licensors be liable to you or any person for any indirect, incidental, special, punitive, or consequential damages howsoever caused, under any theory of liability, including, without limitation, contract, tort, warranty, breach of statutory duty, negligence or otherwise, even if Plexus has been advised as to the possibility of such damages or could have foreseen such damages.
Governing Law and Severability
These Terms are governed by the laws of Malaysia and any disputes in relation thereto shall be subject to the exclusive jurisdiction of the courts of Malaysia. If any provision or part of any provision of this Agreement is held to be illegal, invalid or unenforceable by a court or other competent authority, this Agreement shall be construed as if such offending provision (or part thereof) was never included as part of this Agreement and the remaining provisions of this Agreement shall remain in full force and effect.
Changes and amendments
We reserve the right to modify this Agreement or its policies relating to myPlexus or the Services at any time, effective upon posting of an updated version of this Agreement in myPlexus. When we do, we will revise the date at the bottom of this page. Continued use of myPlexus after any such changes shall constitute your consent to such changes.
Privacy Statement
This Privacy Statement forms part of the terms and conditions for the use of myPlexus. myPlexus is Plexus’ property and you should have no expectation of privacy and shall waive all rights of privacy in connection with your use of myPlexus. This includes any data or messages you may create, store, send or receive by or through using myPlexus. Plexus may delete any data including personal data from myPlexus at any time or for any reason without notice. Plexus may retain records of and monitor your usage of myPlexus. By using myPlexus, you indicate your consent for Plexus to track your usage activities for quality improvement and other necessary purposes.
